OSHA Releases COVID-19 Vaccination and Testing Emergency Temporary Standard

The Occupational Safety and Health Administration (OSHA) has released the emergency temporary standard (ETS) that requires employers with 100 or more employees to implement regular COVID-19 testing or vaccination requirements for employees.

Minnesota OSHA will have to adopt a plan that is at least as restrictive as the federal requirements in the ETS. Minnesota OSHA has up to 30 days after the date the ETS is published in the Federal Register (Nov. 5, 2021) to adopt the ETS for Minnesota employers, including cities. When the ETS is published in the Minnesota State Register, it will likely include an effective date for Minnesota employers.
